In Black Hawk, Texas, a longstanding legal battle has reached its peak as a prominent game and hotel establishment in Colorado and the design company they enlisted have found themselves embroiled in a heated dispute. This latest development marks the culmination of their ongoing legal conflicts, which have spanned numerous years of litigation.

According to Monarch Casino Resort Spa Black Hawk, PCL Construction Services Inc. (PCL) completed unsatisfactory work on a construction project worth approximately $250 million, involving expansion and renovation.

Following a previous incident in 2019, where a construction company had a dispute with Monarch Casino over rejected bids with the highest prices, additional lawsuits were filed between the two parties.

During Monarch’s latest event, which was presented to a Denver judge, PCL allegedly delivered substandard and ineffective work. The inadequate design has resulted in problems at the Colorado activity and hotel complex.

The project encompasses a new 23-story tower featuring five levels of casino gaming, podium and rooftop levels for restaurant administration and lounges. It also offers world-class luxury hotel rooms and suites on levels 6-23. Furthermore, the project includes significant updates and luxury renovations to the existing game.

It appears that things have gone awry since the decision to reset in 2016. Monarch has raised several claims against PCL, each one focusing on various subjects.

There were still two problems with the issue.

The initial issue arose from PCL & S’s dishonest handling of the project.

  • PCL & is unable to provide the project plan, despite Monarch’s repeated demands.
  • Following the termination of the agreements between PCL, ill, and poorly, Monarch was compelled to finish the task by hiring a different contractor.
  • PCL’s deliberate actions, or lack thereof, in adhering to the Agreement, business standards, express laws, and local building codes have resulted in a significant lack of quality control and workmanship, as per Monarch’s assessment. Consequently, the Project is flawed, compromised, and rendered ineffective.

PCL & was deemed unsatisfactory, inconvenient, and overall bad. Despite numerous issues, the complaint eventually outlined the expected standards. Monarch Casino regarded PCL’s job as a complete failure, to put it simply.

PCL is accused of delivering a flawed, noncompliant, and incomplete Project for the Colorado game because it did not adhere to the Agreement, industry standards, state laws, or local building codes. The complaint further states that there have been multiple instances of subpar work, as well as a significant amount of it.

According to John A. Wharton, an attorney at Greenberg Traurig LLP, there are numerous interior issues including layout problems, as well as mechanical, electrical, and plumbing issues. He further exemplified this by mentioning light fixtures falling from bathroom ceilings.

There are 87 different points of contention listed in the extensive 12-page situation document. It appears to be abundantly clear that PCL’s efforts were ultimately unsuccessful, based on the available evidence.

Wharton told Law360 that the relationship with PCL has been consistently long and extremely tumultuous. The project they worked on together was a complete failure.

Legal disputes have a long history with Colorado Casino and Construction Co.

The project’s guaranteed highest pay in 2019 was a point of contention between the two companies, resulting in their inability to reach an agreement. PCL initially accused the game of not paying them on time. The most recent conflict between Monarch Casino and PCL occurred three years ago.

Monarch Casino alleged that PCL had not provided a guaranteed optimal budget or plan for the expenses to be covered in relation to the matter. A payment for the 2019 matter is set to be issued in September of the current year.

PCL filed yet another lawsuit against Monarch in 2021, with additional subcontractors also joining the case against Monarch Casino. However, the determination of their value may be postponed until the initial problem from 2019 is resolved.

The ongoing legal disputes between PCL and the Colorado casino appear to have no resolution in sight.
